TSH&D Clinches Big Success for Small Business Client Against Uber Technologies, Inc.

TSH&D partners Benjamin Hincks and Michael Day were featured in Massachusetts Lawyers Weekly article, “Trade Secrets Suit Against Uber can Proceed in BLS” by Eric T. Berkman. Ben and Michael secured a significant win for client, Zemcar, inc. d/b/a Grip Mobility, Co., in its trade secrets lawsuit against Uber, after Judge Deborah A. Squires-Lee ruled that the case may proceed in Massachusetts despite Uber’s attempt to enforce a Brazilian forum-selection clause.

The ruling allows Grip to continue pursuing allegations that Uber used confidential information obtained during Grip’s rideshare safety technology pilot program to develop competing products in its home jurisdiction and advances the startup’s effort to hold Uber accountable for the alleged misuse of proprietary technology.
