August 5, 2013 – Michael S. Day, a partner in Torres, Scammon & Day, LLP, recently obtained a compelling verdict on behalf of the firm’s client, Robert J. O’Brien, Trustee of the Plympton Trust, after a two-day jury trial in Middlesex Superior Court involving allegations of fraud and breach of a promissory note.
The jury found in favor of the plaintiff on all counts, awarding the full amount of the promissory note at issue as well as damages for claims alleging that the defendant committed fraud and was wrongfully holding the plaintiff’s funds. After trial, the Middlesex Superior Court also awarded the plaintiff the full amount of attorneys’ fees and costs he expended in the case and three-years’ interest on the damages awarded.
